கொச்சி: சனிக்கிழமை பம்பையில் நடைபெற்ற உலகளாவிய ஐயப்ப சங்கமத்தில் பங்கேற்ற கோயில் அறங்காவலர்கள், நிர்வாக அதிகாரிகள் மற்றும் தேவஸ்வம் வாரிய ஊழியர்களின் பயண மற்றும் உணவுச் செலவுகளுக்காக கோயில் நிதியைப் பயன்படுத்த அனுமதித்த மலபார் தேவஸ்வம் வாரிய ஆணையரின் உத்தரவுக்கு உயர் நீதிமன்றம் வெள்ளிக்கிழமை தடை விதித்தது.

காசர்கோடு, நீலேஸ்வரத்தில் உள்ள கிணவூர் ஸ்ரீ கிராதேஸ்வரர் கோயிலின் எழுத்தர் ஏ. வி. ராமச்சந்திரன் தாக்கல் செய்த மனுவின் பேரில், நீதிபதிகள் வி ராஜா விஜயராகவன் மற்றும் கே வி ஜெயகுமார் ஆகியோர் அடங்கிய அமர்வு இந்த இடைக்கால உத்தரவைப் பிறப்பித்தது. செலவுகளைச் சமாளிக்க கோயில் நிதியைப் பயன்படுத்த கோயில் நிர்வாகிகளுக்கு அனுமதி அளித்த ஆணையரின் செப்டம்பர் 18 ஆம் தேதி உத்தரவை அந்த மனு சவால் செய்தது. இந்த விவகாரம் தொடர்பாக மலபார் தேவஸ்வம் வாரியத்திடம் இருந்தும் உயர் நீதிமன்றம் விளக்கம் கோரியதுடன், வழக்கை செப்டம்பர் 25 ஆம் தேதிக்கு ஒத்திவைத்தது.

மலபார் தேவஸ்வம் வாரியத்தின் கீழ் உள்ள பல கோயில்கள் கடுமையான நிதிப் பற்றாக்குறையை எதிர்கொண்டுள்ளன என்பதை மனுதாரர் சுட்டிக்காட்டினார். சம்பளம் மற்றும் சட்டப்பூர்வ சலுகைகளைக் கோரி ஊழியர்கள் மற்றும் பணியாளர்கள் நடத்திய பல்வேறு போராட்டங்களில் இது பிரதிபலிப்பதாகவும் அவர் குறிப்பிட்டார். கோயில் நிதி என்பது தெய்வம் மற்றும் அதன் பக்தர்களுக்குச் சொந்தமான அறக்கட்டளைச் சொத்து என்றும், அரசு ஒரு அறங்காவலர் கடமையின் கீழ் ஒரு சட்டப்பூர்வ அறங்காவலராக மட்டுமே செயல்படுகிறது என்றும் அவர் வாதிட்டார். எனவே, அத்தகைய நிதியை வெளி நோக்கங்களுக்காகத் திசை திருப்ப முடியாது என்று அவர் வாதிட்டார்.

கோயில் நடவடிக்கைகள், கோயில் சொத்துக்களின் பராமரிப்பு மற்றும் தொடர்புடைய தொண்டு நோக்கங்களுக்காக ஒதுக்கப்பட்ட நிதியை அதிகாரிகளின் பயண மற்றும் உணவுச் செலவுகளுக்குப் பயன்படுத்தும் உத்தரவு சட்டவிரோதமானது, தன்னிச்சையானது, நியாயமற்றது மற்றும் பக்தர்களின் அடிப்படை உரிமைகளை மீறுவதாகும் என்று அவர் குற்றம் சாட்டினார்.

Kochi: High court on Friday stayed Malabar Devaswom Board commissioner's order that permitted the use of temple funds to cover the travel and food expenses of temple trustees, executive officers and board employees who attended the Global Ayyappa Sangamam at Pamba on Saturday.A bench of Justices V Raja Vijayaraghavan and K V Jayakumar issued the interim order in response to a petition by A V Ramachandran, a clerk at Kinavoor Sri Kiratheswara Temple in Neeleswaram, Kasaragod. The plea challenged the commissioner's Sept 18 order, which had permitted temple administrators to use temple funds to meet the expenses. HC also sought instructions from Malabar Devaswom Board in the matter and adjourned the case to Sept 25.The petitioner further pointed out that many temples under Malabar Devaswom Board are facing acute financial shortages, as reflected in various agitations by employees and staff seeking payment of salaries and statutory benefits. He argued that temple funds are trust property belonging to the deity and its worshippers, with the state acting only as a statutory trustee under a fiduciary obligation. Therefore, he contended, such funds cannot be diverted for extraneous purposes.

The direction to use funds earmarked for temple activities, maintenance of temple properties, and allied charitable purposes to meet travel and food expenses of officials was, he alleged, illegal, arbitrary, unreasonable, and violative of devotees' fundamental rights.

Kerala Devaswom Recruitment Board has sought a stay of the High Court decision while submitting that its functions were limited to affairs of recruitment and did not intervene in the religious duties concerning temples Updated - January 29, 2026

The Supreme Court of India on Thursday (January 29, 2026) stayed a Kerala High Court decision striking down provisions which empowered the Kerala Devaswom Recruitment Board (KDRB) to appoint candidates to various posts in the Guruvayur Devaswom and aided educational institutions.

A Bench headed by Justice Vikram Nath issued notice on the appeal filed by the KDRB, represented by senior advocate V. Giri and advocate Deepak Prakash. The court fixed the next hearing on February 23, 2026.

The KDRB has sought a stay of the High Court decision while submitting that its functions were limited to affairs of recruitment and did not intervene in the religious duties concerning temples.

The High Court had directed that proceedings relating to the appointment or selection of candidates to posts must be done as per the Guruvayoor Devaswom Act, 1978. The High Court direction had come on an appeal filed by the Guruvayur Devaswom Employees Union Congress and others, challenging the relevant provisions of the KDRB Act.

The court had quashed the notification issued by the KDRB inviting applications for various posts and added that the KDRB should not in future conduct any selection proceedings for appointments to these posts. Appointments already made by the board would remain undisturbed.

In addition, the managing committee of Guruvayur Devaswom was directed to initiate the appointment process afresh, while a special committee would supervise and control the entire process. The committee headed by retired Judge of the Kerala High Court, Justice P.N. Ravindran, would have a one-year tenure.
