Raif Badawi- Saudi Jailed Blogger awarded Sakharov human rights prize

Saudi blogger Raif Badawi, who was recently sentenced to 10 years in prison, 1,000 lashes, a fine of quarter of a million US dollars and prevented from travelling until 2034 for blogging about free speech.

Saudi blogger Raif Badawi, whose flogging sentence caused an outcry, has been awarded the European Parliament's Sakharov human rights prize.
Parliament President Martin Schulz urged Saudi King Salman "to free him, so he can accept the prize".
Mr Badawi was sentenced to 10 years in jail and 1,000 lashes in Saudi Arabia for "insulting Islam".
Earlier this month he also won the Pen Pinter Prize for championing free speech.
The Sakharov Prize for Freedom of Thought has been awarded by the European Parliament since 1988 to individuals or organisations for their contribution to the fight for human rights and democracy.
It is named after the Soviet scientist and dissident Andrei Sakharov.

Flogging postponed

Mr Badawi, author of the website Free Saudi Liberals, was convicted of insulting Islam in 2012 and fined £175,000.
He received the first 50 lashes of his sentence in January, but subsequent floggings have been postponed.
In June, Saudi Arabia's Supreme Court upheld the verdict despite a foreign outcry.
"This man, who is an extremely good man, an exemplary man, has had imposed on him one of the most gruesome penalties," Mr Schulz told a packed European Parliament assembly in Strasbourg, France.
"I call on the Saudi king to immediately free him. Relations depend on human rights being respected by our partners... they are not only not being respected but are being trodden underfoot."
Guy Verhofstadt, leader of the European Parliament's Liberal bloc, said: "The European Parliament has sent today a strong political and humanitarian message to Saudi Arabian authorities."
Mr Badawi's wife Ensaf Haidar, now living Canada with their children, said the award was a "message of hope and courage".
"I thank the European Parliament," she told AFP news agency.
Mr Badawi was one of three nominees for this year's prize along with assassinated Russian opposition leader Boris Nemtsov and the Venezuelan opposition movement Mesa de la Unidad Democratica.
Previous winners include Nelson Mandela, Myanmar activist Aung San Suu Kyi and Pakistani education campaigner Malala Yousafzai.

European parliament president Mar tin Schulz said Badawi was “an ex tremely and an exempla ry good man“. “I call on King of Saudi Ara execution of bia to stop the execution of this sentence, to release Badawi and allow him to travel here for the December session to receive this prize,“ Schulz added. The award ceremony will be held in Strasbourg on December 16.
Badawi was arrested on June 2012, charged for content he had posted to his website `Saudi Arabian Liberials', including an article published on Valentine's Day in which he was accused of ridiculing Saudi Arabia's religious police.
The Sakharov prize, named after Soviet scientist Andrei Sakharov, has been awarded since 1988 to individuals or organisations who have made significant contribution to the struggle for human rights and democracy .

Dr.M. Anandakrishnan was speaking at the launch of ‘Naller Publications’ organised by Tamil Maiyam, a not for profit organisation dedicated to promoting Tamil art, literature and culture, here on Friday. Apart from linguistic research, the publication would focus on social and political research, said Jegath Gaspar Raj, chairman, Naller Publications.
During the launch, 20 books authored by M.S. Victor, a Tamil scholar, were released. These books dealt with Mr. Victor’s research on the similarities between Tamil and western languages, and included titles such as ‘Tamil and Hebrew’ and ‘The Babylonian Tamizh.’

Andimuthu Raja, the tainted ex-minister, has also charmed NGOs. Jagat Caspar, a synthetic priest wearing designer clothes and travelling in upmarket SUVs, is a well known associate of Kanimozhi and Raja and was raided by the CBI recently. His NGO Tamil Maiyam, of which Kani is a trustee, has been organising folk festivals in Chennai with heavy funding from Kani’s father’s government. When the local media exposed special government orders being passed to release funds to this NGO, Jagat Caspar and Kanimozhi called a press meet to declare that all accounts of the folk festivals would be put up on their website immediately after the festival. Two annual festivals have gone and nothing has appeared on the website yet.

The discrimination between classical artistes and folk artistes in the festivals has also been exposed in the local media. Jagat Caspar, by his own admission, has been a mediator for LTTE during the last phase of the Eelam war.
When the spectrum scam rocked Parliament recently, Jagat Caspar and Raja’s friends organised  a public meeting to condemn the media for irresponsibly hounding Raja. The meeting in defence of Raja was presided over by another NGO honcho AS Panneer Selvan, who is head  of PANOS  South Asia. The posters and advertisements  for the function carried his designation with PANOS to lend credibility to the meeting.

The Supreme Court has decided to examine Islamic personal law to consider doing away with provisions biased against Muslim women, often victims of polygamy and the triple talaq system, a controversial move that may upset a section of the community that has resisted reform.
A bench of justices AR Dave and AK Goel requested Chief Justice of India HL Dattu to constitute an appropriate bench and address the issue to bring about gender equality in Muslim personal law in line with the Constitution that prohibits discrimination on the basis of sex.
“There is no safeguard against arbitrary divorce and second marriage by her (a Muslim woman’s) husband during currency of the first marriage, resulting in a denial of dignity and security to her,” the bench said.
“Laws dealing with marriage and succession are not part of religion. Law has to change with time,” they added, citing an earlier judgment.
The judges analysed several SC judgments on gender discrimination in Muslim law and issued notices to the attorney general and the National Legal Services Authority, asking them to respond by November 23.
India has separate personal laws for each religion that govern marriage, succession, adoption and maintenance. Hindu family laws were modified in the 1950s but activists have long argued Muslim personal law, which has remained mostly unchanged, is tilted against women. It allows polygamy and the use of the triple talaq system.
Women are discriminated against in succession and inheritance of property. Also, two female witnesses equal one male witness in a Muslim marriage. In a survey conducted earlier this year, over 90% of Muslim women rejected triple talaq and polygamy.
“The practice of polygamy is injurious to public morals and can be superseded by the State just as practice of sati,” the bench said, quoting from a 2003 verdict.
Noted Islamic scholar and former chairman of the National Commission for Minorities Tahir Mahmood supported the SC’s move.
“There is a misconception that Muslim personal law is covered by the right to religious freedom under the Constitution. Personal laws are within the legislative competence of the state. There is no doubt in practice Muslim women are discriminated against. The legislature has done nothing to end it. The SC must take cognizance of such discrimination and do something for them,” Mahmood said.
The order comes days after another SC bench asked the Centre to quickly decide on a uniform civil code to end confusion over personal community laws. The bench noted though the issue came up before the SC in the past, the court refrained because “a climate was required to be built for a uniform civil code”.
The court said the matter needed consideration because it was related not just to policy but also fundamental rights of women to equality, non-discrimination, life and liberty.
In 1985, the Supreme Court awarded maintenance to a 60-year-old divorced Muslim woman, Shah Bano, but the then Congress government reversed the verdict after pushback from the clergy and Muslim Personal Law Board.
The court said the Muslim Women (Protection of Rights on Divorce) Act, 1986 that was passed during the Rajiv Gandhi government needed to be examined by a Constitution Bench. India’s criminal procedure code guarantees maintenance to divorced women throughout their lifetime unless they remarry.

The Supreme Court on Monday gave the government three weeks to come up with a proposal to amend the Christian divorce act while asking it to take a quick decision on a uniform civil code to end the confusion over personal laws.
“If you want to have a uniform civil code have it, you want to follow the uniform civil code, follow it. But you must take a decision soon,” a bench headed by justice Vikramjit Sen told solicitor general Ranjit Kumar.
The court is hearing a public interest litigation filed by a Delhi-based man, seeking waiver of two-year mandatory separation period before a Christian couple can move court for divorce by mutual consent. The separation period is one year for other religions.
India has separate sets of personal laws for each religion governing marriage, divorce, succession, adoption and maintenance. While Hindu Law overhaul began in the 1950s and continues, Christian and Muslim laws are relics of the colonial era.
This is the second time in four months that the court reminded the government of its responsibility as enshrined in the Constitution.
Article 44 says the state shall work towards securing a uniform civil code across the country replacing personal laws of various religious communities. The provision is a part of the Directive Principles of State Policy that are not enforceable by any court but, says Article 37, the government is duty-bound to apply them in making laws.
“What is happening? Why is this happening? It’s total confusion….The petitioner is just seeking that the Christian law should be on the same platform as that of the Hindu law as their personal law (Christian) prescribes a minimum of two years, whereas others have one year,” the bench said.
Albert Anthony has challenged the validity of Section 10A (1) of the Divorce Act, 1869, saying the two-year mandatory period of separation was biased against the Christian community amounting to “hostile discrimination”.
The Kerala and Karnataka high courts had declared the provision unconstitutional but Christians living in the other states were being denied benefit of the two judgments, he said.
Granting relief to unwed mothers who did not want to reveal the name of their child’s father in a guardianship case, justice Sen had in July strongly advocated such a code.
“India is a secular nation and it is a cardinal necessity that religion be distanced from law. Therefore, the task before us is to interpret the law of the land, not in light of the tenets of the parties’ religion but in keeping with legislative intent and prevailing case law,” he had said.
Not just courts, but activists, too, are of the view that common secular personal laws will go a long way in bringing about gender parity.
“A common civil code will help the cause of national integration by removing disparate loyalties to law which having conflicting ideologies,” CJI YV Chandrachud said in the Shah Bano maintenance case in 1985.
Ten years later, the court declared invalid the second marriage of a Hindu man who converted to Islam to marry without divorcing his first wife. “It appears that…the rulers of the day are not in a mood to retrieve Article 44 from the cold storage where it is lying since 1949,” justice Kuldip Singh said in what came to be known as the Sarla Mudgal case.
A uniform civil code, however, remains a contentious issue. While the BJP, which leads the government at the Centre, has been demanding it for long some minority groups are opposed to it.

The Catholic Bishops Conference of India has welcomed the government's decision to withhold the release of theDa Vinci Code in India until representatives of the government and Catholic church view the controversial film.
"The movie is a false and irrelevant portrayal of Jesus Christ. It attacks the very root of Christian faith. It maligns Christ, so the government's move not to clear the movie is a welcome step," CBCI Deputy Secretary General Father Donald De Souza told rediff.com on Wednesday morning.
