cial tahsildar for the Erode Urban Land Tax Project, S Sampath, on Sunday recommended to the Erode tahsildar that steps be taken to take over and maintain a 12.66-acre disputed government property on Brough Road, said to be worth over Rs 900 crore, after seeking the Collector’s advice.
The Church of South India (CSI) has claimed that the land belonged to the CSI trust. According to the CSI administration, a Christian missionary, HA Papli, bought the land in an auction held in 1905 at a price of Rs 12,910 and handed it over to the London Mission (CSI) in 1907. As the trust was unable to get a patta for the property from the tahsildar, it approached the assistant Urban Land Tax Project Officer, Chennai, in 2010.
On June 30, 2010, the officer recommended necessary corrections on the government records to give the patta to the trust.
On that basis, the trust approached the tahsildar a second time. But, the tahsildar and some others appealed against the order with the Commissioner for Land Revenue and Settlement, who, after perusing the records (survey No 586 and 587) found that the property was mentioned as government land. Hence, he cancelled the order of the Assistant Urban Land Tax Project Officer and ordered a de novo probe by the special tahsildar.
On the basis of documents submitted by both the parties, Sampath passed an order on July 10, 2012, stating that the CSI trust did not submit any registered document of HA Papli, his successor Anthony Watson Brough or the present authorities, to prove that the land was bought in an auction.
He also found many anomalies in the auction records and the title deed of HA Papli, which were produced by the trust. Papli did not have any right to transfer the land to the London Mission (CSI) in 1907, he noted, while adding that the land registration did not fulfil the norms. The revenue department has been asked to record it as ‘government poromboke land’. There was no need to recover the land  as it already belonged to the government, the order said.

Hundreds of devotees taking part in the festivities of Sri Periya Mariamman Temple were arrested on Thursday when they were proceeding towards a land under dispute to prepare Pongal.
An area of 12.66 acres under the possession of Church of South India is claimed by Sri Periya Mariamman Temple Land Retrieval Movement as the original property of the temple.
Representatives of the Movement questioned the rationale behind permitting CSI to retain the land even after a government survey establishing that it was under unauthorised possession.
They criticised the district administration for not doing enough to retrieve the land for the purpose of laying 80 feet road linking the Brough Road with the Chennimalai Road.
Referring to the speed with which land was acquired from private owners for the proposed traffic island at Government Hospital Junction, they charged the government authorities with double standards.

Police arrested more than 600 members of the Committee for the Retrieval of Periya Mariamman Temple Land here on Thursday when they attempted to cook sweet rice near the temple protesting against the State government's failure to remove the encroachments on the temple land.
A large number of men and women gathered at the Eshwaran temple premises and took out a procession towards the Periya Mariamman temple carrying pots, rice, firewood, sugarcane and turmeric. Committee president M. Chandrasekar led the procession.
A team of police personnel prevented the members at Thiruvenkadasamy Street and asked them to withdraw their protest.
Members refused to do so and a few them even attempted to cook rice in the middle of the street.
Police arrested the members and released them later in the evening. The arrested persons included 406 women.
The committee had been protesting for long to retrieve the temple land from those who were occupying it.
Committee members also wanted the government to implement the 80-foot road project in order to ease the traffic congestion that prevailed in the town.
If implemented, it would establish better road connectivity between the Erode Railway Junction and the Brough Road, they pointed out.
A total of 406 women took part in the protest and were arrested

The Madurai bench of the Madras high court on Monday restrained the
managementof St Peter and Paul Church at Serndhamaram in Tirunelveli 
district from making  any further construction or alteration at the site of
 a 1,000-year-old Shiva temple located close to it. The bench of 
Justice V Ramasubramanian and Justice V M Velumani was hearing
 a petition filed by S Arumugam, a resident of Serndhamaram village.
Seeking inspection by an expert committee, Arumugam’s counsel 
T Lajapathy Roy contended that the church management is now
 attempting to destroy the temple  structure. He said the temple 
had a ‘Lingam’ in the sanctum  sanctorum and idols of deities 
sculpted on its pillars and  hence it is necessary to have an
 expert committee set up under  the guidance of an archaeologist
 to study the structure.
The petitioner sought directions to the state’s archaeology
 department to notify the temple as an ancient monument 
and to the collector take over the temple property.
According to the petitioner, the church management encroached
 on the temple land during the British rule and constructed the
 church after demolishing the temple's entrance. It allowed the 
villagers to celebrate temple festival till 2012, but after that even that 
was denied, the petition said.
In 2005, the church initiated action to get some more land, but the
special commissioner and commissioner of land administration in
 Chennai refused, it said. When the church management constructed
 a shopping complex in 2013 on the temple land, the tahsildar passed
 an order on April 22, 2013 to remove it, the petitioner said.
When the matter was brought to the notice of the district superintendent
of police, an archaeological officer was appointed to study the issue.
He visited the temple site on October 7, 2013 and filed a report
 saying there was no co-operation from the church management
and he was restrained from entering the temple, the petitioner said.
Further, the inspector of the Hindu Religious and Charitable Endowment
 department said in a report dated March 17, 2014 that the church had
 encroached on the temple land, he said. After hearing the matter, the bench
granted an interim injunction and adjourned the matter by three weeks to
 enable the government and the church to file their replies.
The church's counsel K Mahendran said cases have been filed against the orders
 of the commissioner of land administration and the tahsildar.
Both the cases are pending, he said.

Land in Chennai was leased to CSITA: Defence Estates Office

The decades-old dispute between the Church of South India Trust Association (CSITA) and St. Andrew's Church (The Kirk) over possession of 9.47 acres of land in Chennai took a new turn with the Defence Estates Office rejecting the claim made by the Kirk that the “land at Vepery village absolutely belongs to it.”

The Defence Estates Office, Madras Circle, in its communication on July 16, 2010, has informed the secretary of the Kirk Session that the land along with the building comprising the Church belonged to the Ministry of Defence and that it had been leased out in favour of CSITA.

The communication also stated that it had reasons to believe that the Kirk Session was planning to construct a shopping complex on the defence leased site and stressed that the lessee of the property could use it only for church purposes.

  
Unanimous move
According to V. Devasahayam, Bishop, Madras Diocese, St. Andrew's Church, established by the Church of Scotland, joined the union of CSI in 1959, on the basis of a unanimous resolution. It was approved by the general assembly of the Church of Scotland and the properties of the Church stood transferred to CSITA.
The CSI was formed by integrating Anglican, Methodist, Presbyterian, and the Congregational churches in Tamil Nadu, Kerala, Karnataka, and Andhra Pradesh, the Union Territory of Puducherry, and the north and east of Sri Lanka. CSITA was formed in 1947 as a legal body to hold moveable and immoveable properties of the CSI.
The Bishop also furnished several documents supporting CSITA's rights over the land. In February 1988, the Ministry of Defence conveyed to the then Bishop, Sundar Clarke, that the government had taken a decision to recognise the transfer of St. Andrews Church from the Church of Scotland Colonial Chaplaincy Board to the CSI and transfer land and properties of the Church to CSITA.
Even in 2008, P. Chidambaram, Union Home Minister, who then held the portfolio of Finance, wrote to Defence Minister A.K. Antony asking him to consider the request of CSITA and issue appropriate orders.
On the other hand, the Kirk Session has been maintaining that St. Andrew's Church has not joined the CSI and continued to remain an autonomous entity, acting under the terms of an Act of the general assembly of the Church of Scotland of 1899.
But the Bishop, citing a letter from Dr. Finlay A.J. Macdonald, Principal Clerk, The Church of Scotland, pointed out that the legislation was revised many times, most recently in 2003, and the 1899 legislation “has no current force.” “The congregation today comes entirely within the jurisdiction of the CSI and cannot claim that its affairs are regulated in any way by the Church of Scotland,” the letter from Mr. Macdonald stated.
Bishop Devasahayam remarked that “the St. Andrew's Church arguments are inconsistent.” He explained: “In its earlier communications, including its letter in 1993, to the Director General, Defence Estates, the Kirk only wanted the lease of the property in its favour, but it subsequently started claiming that it was the owner of the land. Earlier the Kirk maintained that it does not want to secede from the CSI, but only wanted to make provision in the lease to meet the eventuality, however remote it may be. Now the Kirk claims that it is not part of the CSI.”
A legal notice sent by the Kirk, in April 7, 2010, said a chance discovery of an extract in “A” register during examination of archives had proved that the property belonged to the St. Andrew's Church. Asked about this claim, Bishop Devasahayam, said the argument does not hold water since the extract of the so-called “A” register has not been produced to anyone for the last couple of years.
“Even if one accepts the version of St. Andrew's Church for the sake of argument, it goes to establish that the property forms part of the property of the Church of Scotland and it had recognised CSITA as its legal successor. It also transferred all the 146 properties to CSITA,” he explained.
As regards the property occupied by St. Andrews Church, he said, since the property belonged to the government of India, it took some time to recognise the change of congregation of St. Andrew's Church before transferring the properties to CSITA.
“Unfortunately some vested interests in the St Andrew's Church are attempting to dilute the authority of the CSI/CSITA for reasons best known to them,” the Bishop observed. “There is an attempt to grab the Defence land. The question now is whether the Ministry of Defence will encourage an attempt of land grabbing or will it execute the agreement for the already sanctioned lease with CSITA and defend the Defence Land.”
