சென்னை: செங்கல்பட்டு மாவட்டத்தில் உள்ள பெருமாள் கோயிலுக்கு குடமுழுக்கு நடத்துவதற்கான நடைமுறைகளை 12 வாரத்தில் மேற்கொள்ள வேண்டும் என தமிழக அரசுக்கு சென்னை உயர் நீதிமன்றம் உத்தரவிட்டுள்ளது. செங்கல்பட்டு மாவட்டம் பாபுராயன்பேட்டையில் ஸ்ரீவிஜயவரதராஜ பெருமாளுக்கு புராதன கோயில் அமைந்துள்ளது. இந்த கோயிலில் உள்ள உட்பிரகாரம், வெளிப்பிரகாரம், தூண்கள், கல்மண்டபம், குளம், விமானங்கள், கோபுரம் ஆகியவை சிதிலமடைந்து காணப்படுகிறது. இதனை சீரமைத்து, திருப்பணிகளை மேற்கொண்டு கோயில் குடமுழுக்கு விழாவை நடத்த கோரி வக்கீல் பி.ஜெகன்நாத் என்பவர் பொது நல வழக்கு தொடர்ந்தார்.
இந்த வழக்கு நீதிபதிகள் எம்.எம்.சுந்தரேஷ், ஆர்.ஹேமலதா ஆகியோர் அமர்வில் விசாரணைக்கு வந்தது. அப்போது, தமிழக அரசு தரப்பில் ஜி.கே.முத்துக்குமார், அறநிலையத்துறை தரப்பில் ஆர்.வெங்கடேஷ் ஆகியோர் ஆஜராகி வாதிட்டனர்.
அதில், அறநிலையத்துறை தரப்பில், புராதன கோயில்களுக்கு குடமுழுக்கு செய்வதற்கு மாவட்ட மற்றும் மாநில அளவிலான குழுக்களிடம் அனுமதி பெற வேண்டியுள்ளது. அந்த அனுமதி கிடைத்த பிறகு குடமுழுக்கு குறித்து முடிவெடுக்கப்படும் என விளக்கம் அளிக்கப்பட்டது. இதை பதிவு செய்த நீதிபதிகள், குடமுழுக்கு நடத்துவதற்கான நடைமுறைகளை 12 வாரத்தில் மேற்கொள்ள வேண்டும் என அரசுக்கு உத்தரவிட்டு வழக்கை முடித்து வைத்தனர்.

Petition filed under Article 226 of the Constitution of India praying to issue a writ of mandamus directing the respondent Hindu Religious and Charitable Endowment Department to reconstruct, repair the damages and perform Thirupani Renovation of Arulmighu Sri Vijaya Varadaraja Perumal Temple situated at Baburayanpettai Village in Kancheepuram now Present Chengalpattu District including the renovation and reconstruction of the Inner and outer Praharams Pillars Kal Mandapams Temple Tank all the Vimanams and Gopurams and perform Kumbabishekam in accordance with the Vadakalai Vaishnavite Sampradaya and Customs within a reasonable time frame as fixed by this Court.

ORDER
(Order of the Court was made by M.M.SUNDRESH, J.) This writ petition has been filed by the petitioner, who appears as party-in-person seeking performance of thirupani renovation in the nature of kumbabishekam.

2. We have heard the petitioner/party-in-person, learned Government Advocate appearing for respondents 1 to 4 and the learned Special Government Pleader appearing for respondents 5 and
3. Learned Government Advocate appearing for the HR&CE Department submitted that the procedural compliance is required to be made through the District and State Level Committees. After compliance of the same, the performance of kumbabishekam will be considered.
4. Considering the aforesaid submission made, we direct the official respondents to undertake the exercise of performing the kumbabishekam within a period of twelve weeks from the date of receipt of a copy of this order.
5. The writ petition stands disposed of accordingly. No costs.
