The Madurai Bench of the Madras High Court on Friday (January 2, 2026) directed the authorities of Hazrat Sultan Sikandar Badusha Dargah on the Thirupparankundram hill to conduct only the Santhanakoodu Urus festival and restrict the total number of participants to 50.

Justice S. Srimathy restrained the dargah authorities from carrying out animal sacrifice, carrying meat and non-vegetarian food, and cooking non-vegetarian food. The direction should be enforced from the foothills to the top, the court said.

The official respondents, including the district administration, were directed to strictly enforce the directions. The police were directed to maintain law and order.

The court was hearing a petition filed by M. Manickamoorthy of Madurai, who sought a direction to the authorities to prohibit the dargah authorities from performing ‘Kandhoori’ on the hill.

The State government submitted that permission would be granted only for the Santhanakoodu festival scheduled for January 6. Permission was granted in 2023, and the same would be followed this year too. It also submitted that permission would not be granted for ‘Kandhoori Mahautsav’. Animal sacrifice, carrying meat and non-vegetarian food, and cooking non-vegetarian food would not be permitted, it said.

The court posted the matter to January 20 for the filing of a counter-affidavit.

திருப்பரங்குன்றம் மலை உச்சியில் உள்ள சிக்கந்தர் தர்காவில் சந்தனக்கூடு விழாவுக்கு மட்டுமே அனுமதி வழங்கப்பட்டுள்ளது. கந்தூரி விழாவுக்கு அனுமதி வழங்கப்படவில்லை என உயர் நீதிமன்றத்தில் அரசு தரப்பில் தெரிவிக்கப்பட்டது.

மதுரை சோலை அழகுபுரத்தைச் சேர்ந்த மாணிக்கமூர்த்தி உயர் நீதிமன்ற மதுரை அமர்வில் தாக்கல் செய்த மனு: திருப்பரங்குன்றம் மலை உச்சியில் சிக்கந்தர் பாதுஷா தர்கா அமைந்துள்ளது. இங்கு கடந்த ஆண்டு கந்தூரி விழா நடத்தி அசைவ உணவுகளை பரிமாற ஏற்பாடுகள் செய்யப்பட்டது. இதற்கு எதிரான வழக்கில், திருப்பரங்குன்றம் மலையில் ஆடு, கோழி பலியிடவும், அசைவ உணவுகளை பரிமாறவும் தடைவிதித்தும், இது தொடர்பான உரிமையை நிலைநாட்ட உரிமையியல் நீதிமன்றத்தை அணுகவும் உயர் நீதிமன்ற அமர்வு உத்தரவிட்டது.

இந்த உத்தரவை எதிர்த்தோ அல்லது உரிமையியல் நீதிமன்றத்தில் வழக்கு தொடரவோ தர்கா தரப்பில் எந்த நடவடிக்கையும் எடுக்கவில்லை. இதனால் திருப்பரங்குன்றம் மலையில் ஆடு, கோழி பலியிட தடை விதித்து உயர் நீதிமன்றம் பிறப்பித்த உத்தரவு இறுதியானது. இந்நிலையில், சிக்கந்தர் தர்காவில் டிச.21 முதல் ஜன.6-ம் தேதி வரை கந்தூரி மற்றும் சந்தனக்கூடு விழா நடைபெறுகிறது. இந்த விழாவுக்கு தடை விதித்து உத்தரவிட வேண்டும். இவ்வாறு மனுவில் கூறப்பட்டிருந்தது.

இந்த மனு நீதிபதி எஸ்.ஸ்ரீமதி முன்பு விசாரணைக்கு வந்தது. மனுதாரர் தரப்பில், திருப்பரங்குன்றம் மலையில் பிராணிகளை பலியிடவும், அசைவ உணவு பரிமாறவும் தடை விதிக்கப்பட்டுள்ளது எனக் கூறப்பட்டது.

அரசுத் தரப்பில், ‘சந்தனக்கூடு விழாவுக்கு மட்டுமே அனுமதி வழங்கப்பட்டுள்ளது. வேறு எந்த நிகழ்வுகளுக்கும் அனுமதி வழங்க மாட்டோம்’ எனக் கூறப்பட்டது. அதற்கு நீதிபதி, ‘சந்தனக்கூடு விழா என்றால் என்ன? எப்படி நடக்கும்?’ என்றார்.

அதற்கு அரசு தரப்பில், ‘குறிப்பிட்ட எண்ணிக்கையிலான நபர்கள் தர்காவில் சில வழிபாடுகளை நடத்துவர்’ எனத் தெரிவிக்கப்பட்டது.

தர்கா தரப்பில், ‘இந்த மனு விசாரணைக்கே உகந்தது அல்ல. ஏற்கெனவே இதை கோரிக்கையுடன் மனு தாக்கல் செய்யப்பட்டு உத்தரவு பிறப்பிக்கப்பட்ட நிலையில், அதே நீதிபதி முன்பாக மீண்டும் அதே கோரிக்கையை வலியுறுத்தி மனுத் தாக்கல் செய்வது ஏற்கத்தக்கது அல்ல.

விதிமீறல்கள் இருப்பின் நீதிமன்ற அவமதிப்பு மனு தாக்கல் செய்யலாம். திருப்பரங்குன்றம் மலை உச்சியில் கந்தூரி விழா நடத்தக் கூடாது என்றுதான் உத்தரவு உள்ளது. திருப்பரங்குன்றம் பகுதியில் அல்ல. மலைக்குக் கீழே கந்தூரி நடத்தலாம்’ எனக் கூறப்பட்டது.

இதையடுத்து நீதிபதி, இடைக்கால உத்தரவு பிறப்பித்து, பதில் மனு தாக்கல் செய்ய உத்தரவிடலாம் என்றார். அதற்கு தர்கா தரப்பில், ‘மனுவே விசாரணைக்கு உகந்தது அல்ல எனக் கூறும்போது, அந்த மனு மீது எப்படி இடைக்கால உத்தரவு பிறப்பிக்க முடியும்?’ எனக் கேள்வி எழுப்பப்பட்டது.

அரசு தரப்பில், ‘இரு தரப்பினரின் உரிமைகள் பாதிக்கப்படக் கூடாது’ எனக் கூறப்பட்டது. தொடர்ந்து நீதிபதி, ‘ஏற்கெனவே ஏற்பட்ட பாதிப்புகளுக்கு என்ன நடவடிக்கை எடுக்கப்பட்டுள்ளது?’ என்றார்.

தர்கா தரப்பில், ‘தர்காவில் பாகிஸ்தான் கொடி ஏற்றப்படுவதாகவும், இறந்தவர்களின் உடல்களை திருப்பரங்குன்றம் மலை உச்சியில் புதைப்பதாகவும் இந்து மக்கள் கட்சித் தலைவர் அர்ஜூன் சம்பத் குற்றம்சாட்டியுள்ளார். இது தொடர்பாக தர்கா நிர்வாகம் சார்பில் புகார் அளிக்கப்பட்டுள்ளது. தர்கா புகார் மீது இதுவரை எந்த நடவடிக்கையும் எடுக்கவில்லை. எங்களை அரசு ஒடுக்குகிறது’ எனக் கூறப்பட்டது.

இதையடுத்து மனு தொடர்பாக அரசு மற்றும் தர்கா தரப்பில் விரிவான பதில் மனு தாக்கல் செய்ய வேண்டும். விரைவில் இடைக்கால உத்தரவு பிறப்பிக்கப்படும் என்று கூறி விசாரணையை நீதிபதி ஒத்திவைத்தார்.
