The Bench remarked that "if an elected government says because of law and order problem, it cannot comply with our order, then let it go”. It observed orally that it would not allow a government to gain political mileage out of flouting court orders.

The same hearing had seen the court pull up the Union Government for not doing its duty to see that the court's orders are complied to.

SC issues contempt notice to Krishna

NEW DELHI: The Supreme Court on Friday again issued notices to Karnataka chief minister S M Krishna, state''s water resources minister H K Patil and state chief secretary A Ravindra on a plea by the Tamil Nadu government for contempt action against them for rejecting the CRA order to give Tamil Nadu 9,000 cusecs of Cauvery water daily.
But a bench, comprising Justice V N Khare, Justice Arijit Pasayat and Justice S B Sinha, exempted the alleged contemners from personal appearance ``for the time being''''.

They have been asked to file their replies to the petition by October 22. The matter will be heard on October 24 along with an earlier TN contempt petition accusing Karnataka of defying the orders of the apex court (September 3) and the Cauvery River Authority (September 8) on release of Cauvery water.
The TN government has quantified the damage due to the continued non-release of Cauvery water by Karnataka at Rs 2,930 crore. State''s counsel K K Venugopal said the entire kuruvai crop was destroyed and the samba crop would meet the same fate.
He said the ``game plan'''' of Karnataka was to divert the Cauvery waters to its six lakh hectares of cultivable land so that TN becomes totally dependent on it for food.

``Do they want something serious to happen in the state of Tamil Nadu? Do they want balkanisation of states?'''' Venugopal wondered and criticised the neighbouring state for adopting a stand of ``your farmers and my farmers''''.
On September 3, the SC had ordered Karnataka to release 1.25 tmc ft water to TN''s Mettur reservoir everyday till a final decision was taken by the Cauvery River Authority (CRA) headed by Prime Minister Atal Bihari Vajpayee. On September 8, the CRA ordered the Karnataka government to release 9,000 cusecs of water daily to TN.
While seeking compensation for the damaged crops, the AIADMK-ruled TN government also sought a direction to the Centre to ask the Congress-ruled Karnataka government under Article 256 of the Constitution to implement the orders of the apex court.
