I have not seen the Film Jai Bheem and I have no intention to see it. From press reports I have come to know that Rajakannu Vs State is the basis for the Film Jai Bhim. The judgement is attached herewith. The judge was Prabha Shankar Mishra from Bihar.
Later he became Chief Justice of Calcutta HC. As he was superceded for elevation to Supreme court, he resigned and practiced as a Senior Advocate in Supreme court. He appeared for several VHP cases.
The result of the case was more to the judicial activism of the judge rather than the efforts of K Chandru.
In one case he ordered the then Commissioner of Police, Chennai to stand in his court and refused give him seat . On that day, the commissioner was directed to appear before the bench headed by PS Mishra. When the judges entered the Court hall they found the Police Commissioner Sri Pal occupying a chair of the Advocates around the Horse Shoe Table . Justice Mishra asked the Commissioner Sri Pal to stand up and explain as to why he sat on the table meant only for Advocates. Sri Pal answered that when ever he had come to court he would sit in chair around the Horse Shoe Table.
PS Mishra pounded on him like anything and made stand for the whole day and passed a judicial order prohibiting non lawyers from sitting in the Horse Shoe table.
PS Mishra was a terror to the erring police officials and gave relief to several persons affected by illegal police action. The legal concept of state government being responsible for the illegal actions of the officials was developed by him only as for as Tamil Nadu is concerned. He was so independent and had lateral thinking and original in his approach.
But for him Chandru would not have succeeded in the Rajakannu case. As he became VHP activist after his resignation, his contribution is ignored. Magazines like Nakkeeran had indulged in character assassination against him. Had he been a leftist he would have been celebrated like God by the Tamil media. Since he became part of Hindutva brigade he has been not only ignored , but his character assassinated.
I have not seen Chandru referring to Justice PS Mishra s name in any of his interviews after the Film Jai Bheem. Magazines like Junior Vikatan which received judicial protection against illegal State action has also denied due recognition to him. Later our Karyakarta Advocate R Nandakumar from Kulithalai, Trichy District had obtained similar relief. Our heros also should be given their due share if not celebrated
